Probate Litigation Support

Our trial attorneys have deep experience in working with clients to resolve their probate issues and guide them through the litigation process. Here are some of the situations in which you should consider the services of a probate litigation attorney.

  • The deceased individual’s assets are not eligible for transfer outside of probate. Some estates are set up for simple execution through the use of trusts, joint tenancy, or rights of survivorship. Similarly, retirement accounts and life insurance policy proceeds are transferable outside of probate because beneficiaries are named.
  • The estate does not fit into “small estate” procedures. Texas has a “summary probate” system in which small estates are executed through simpler processes.
  • Family members intend to dispute the will and contest it in probate court.
  • Surviving relatives and creditors can contest a will, or raise issues that may arise upon a person’s passing. These can be related to disinheritance, or simply that heirs do not receive full inheritance.
