BoyarMiller Argues Before 5th Circuit
HOUSTON, Texas (November 3, 2009) —The United States Court of Appeals for the Fifth Circuit heard oral arguments by BoyarMiller’s Lee Collins, Litigation Group Shareholder, on behalf of GGP-Bridgeland, L.P., Bridgeland GP, LLC, and Safeco Insurance Company of America, and counsel for Addicks Services, Inc. at South Texas College of Law in the T. Gerald Treece Courtroom.
The crux of Addicks’s appeal was whether releases executed by Addicks over the course of a construction project were enforceable and, if so, whether Addicks could avoid their enforcement based on its counterdefenses of ambiguity, waiver and promissory estoppel.
